A California City Attorney is suing the developer of the so-called "leaning tower of San Francisco."
Dennis Herrera filed the lawsuit on Thursday against Mission Street Developers.
San Francisco's City Attorney alleged the builder violated the law by failing to disclose issues with the residential building settling, sinking and leaning with prospective buyers.
Herrera says his investigation found that the developer knew of the problems at the 59-story luxury tower more than a year before multi-million dollar condos first went on sale.
The tower has sunk 16 inches since it was completed seven years ago. It's not, however, sinking evenly, creating a tilt.
The building's problems have raised concerns because it lies in an earthquake fault zone, but city officials, owners of the building's high-end apartments and its developers are arguing over who is to blame.
The developer blames nearby construction of a new city transportation hub and it's drainage of groundwater for the building's problems.
Herrera said his office is currently only filing civil charges against the developer at this point...but wouldn't rule out recommending criminal charges in the future.
