New Jersey is one of several states that allows individuals convicted of certain crimes to expunge their records. Under N.J.S.A. 2C:52-7, a person who has been convicted of less than two indictable offenses (i.e. felonies) in their lifetime is presumptively entitled to an expungement after an established waiting period. For misdemeanors, that waiting period is five years after the fine or other sentencing has been satisfied. For felonies, the waiting period is 10 years. However, the expungement statute spells out circumstances under which some individuals may qualify for an early pathway expungement.
