Intel Corporation v. Hamidi | 71 P.3d 296 (2003)

When automobiles replaced the horse and buggy, it took a while for states to enact speed limits. We now live in a world with buzzing drones and driverless cars. Once again, it’ll take the law a while to catch up with issues related to these technological advances. In Intel Corporation versus Hamidi, the California Supreme Court considered whether an old tort applies to a thoroughly modern problem.

Kourosh Hamidi wasn’t happy about being fired by Intel. So, he set up a website called FACE-Intel and deemed himself webmaster. Over the next two years, Hamidi sent six separate emails to thousands of Intel employees. The emails disparaged Intel’s employment policies and practices. Hamidi circumvented Intel’s numerous attempts to block his emails and ignored a cease and desist letter from Intel’s attorneys.

Intel sued Hamidi and FACE-Intel in California Superior Court, alleging trespass to chattels and nuisance. Intel sought a permanent injunction preventing Hamidi from sending future emails. Before the case was heard, Intel dismissed its nuisance claims. The trial court entered a default judgment against FACE-Intel and granted Intel’s motion for a permanent injunction. Hamidi appealed.

The Court of Appeal affirmed the trial court finding that Hamidi’s intermeddling with Intel’s computer system was a trespass to chattels and that Intel didn’t have to prove actual damage to the system. The disruption of Intel’s business was a sufficient basis for the permanent injunction. Hamidi appealed.

The California Supreme Court granted Hamidi’s petition for review.
