"When we create an estate plan for a client, we're not concerned just with the documents we're creating for the client, but also with the people the client is going to appoint to fulfill all the roles. So a good estate plan is going to include a will, sometimes a revocable trust if that's appropriate for the client and their family, a power of attorney, a healthcare surrogacy and a HIPAA waiver and a living will, and in each of those documents, our client is selecting people to fulfill the roles they are going to need. So, for example, a discussion of who is going to be your personal representative in your will or your successor trustee in your trust or your power of attorney or your healthcare surrogate, should include, and does include in our office, a discussion about who these people are in our client's life and whom do they want to select. In many cases, our clients are choosing the oldest child to fulfill a role and part of the discussion needs to include a conversation with our clients about whether or not all of their children get along with each other, cooperate with each other, whether there's friction among the children, because if so, appointing one child as responsible party over the others may result in conflict among the children at a time when our client doesn't need it. A good estate plan should avoid those things, and at our office, when we sit down with our clients, that's part of what we strive to do."
