People v. Thousand | 631 N.W.2d 694 (2001)

On the Internet, nobody knows you’re a dog. Or a cat. Or a cop. Everyone knows that now, but back in 1998, it still came as a surprise to some people, like the defendant in People versus Thousand.

Deputy William Liczbinski was investigating Internet crimes. Using the screen name Bekka, he represented himself as a 14-year-old girl in an Internet chat room. Christopher Thousand, using the screen name “Mr. Auto-Mag,” approached Bekka. He told her his name, said he was 23 years old, and sent her a photo of his face. Over the next few days, Thousand’s conversations with Bekka became sexually explicit. He sent her a photo of his genitalia and invited her to meet him for sexual acts, which he described in graphic detail. He asked her if she looked over sixteen.

Thousand finally arranged to meet Bekka at a McDonald’s. He said they’d then go to his house, where he’d tell his brother that she was seventeen. He told her to wear a sexy skirt and described his outfit. Bekka asked him to bring her a white teddy bear as a present. The day of the meeting, Thousand walked into the McDonald’s. Liczbinski, waiting in the restaurant, recognized his face from his photograph. Not spotting Bekka, Thousand walked back out. Officers arrested him in the parking lot. They found two white teddy bears in his car.

Thousand was tried for attempted distribution of obscene material to a minor. The circuit court dismissed the case, holding that, because there was no child victim, Thousand couldn’t have committed that crime. The Court of Appeals upheld the dismissal of this charge. The prosecution appealed to the Supreme Court of Michigan.
