Brigade Enterprises Ltd have committed offences which disclose cognizable offences punishable under section : Section 406 of IPC- Punishment for Criminal Breach of Trust, 420 of IPC - Cheating and dishonestly inducing delivery of property, ,Section 211 of IPC- False charge of offence made with intent to injure, Section 288 of IPC - Negligent conduct with respect to pulling down or repairing buildings , and section 423 of IPC - Dishonest or fraudulent execution of deed of transfer containing false statement of consideration.
Few of the Committed Breach of contract listed below:
a) Misrepresentation of Delivery
b) Misrepresentation of Occupational Certificate and advertisement induced me/public to
purchase
c) Deficiency of Service - Pending jobs in house were not completed
d) Misrepresentation of house QA certificate, house offered is unsafe
e) Money of broken lamp was not refunded
f) house civil work was not delivered in quality
g) Unilateral and arbitrary documentation which does not follow the spirit of RERA Act.
h) Brigade witnesses signed instead of my witness after I left sub registrar and not in my
presence
i) Delivery of Villa is not as per signed Agreement specification
j) Property tax, electricity and maintenance are builder responsibility which he transferred to
me as an owner when project has no completion certificate.
k) FAR of 83.98 sqm denied by builder
l) Execution of sale deed in fraudulently by Brigade not informing to bring two witnesses so
their witnesses could sign ad identifies as my witness.
m) Execution of sale deed without BESCOM and water connect
