Webb (plaintiff) saved McGowin (defendant) from being crushed to death by throwing himself down with a log, severely crippling Webb and rendering him unable to work. McGowin agreed to financially support Webb for the rest of Webb’s life with biweekly payments and did so. After McGowin’s death, his estate stopped making the payments. Webb sued to recover the unpaid installments. Trial court granted motion to dismiss Webb’s complaint. Webb appeals.
