People v. Staples | 6 Cal. App. 3d 61 (1970)
When does a burglary attempt begin? With an idea? With a first act? Or when a would-be burglar is just about to get his or her hands on the loot? The court struggled with this difficult calculation in People versus Staples.
Edmund Staples was a mathematician. Thinking he might branch out into bank robbery, he rented an office directly over a bank. He hauled in drills, a blowtorch, gas tanks, a blanket, and a linoleum rug. On Saturday, when no one was in the building, he drilled two holes in the floor, stopping before he went all the way through. He covered his handiwork with the linoleum rug. The landlord noticed this unusual behavior and called the police.
Staples confessed to planning to rob the bank. He said he stopped drilling the holes due to fear of the implications of what he was doing. He’d begun to think that his idea of becoming a bank robber was absurb, and that he might enjoy being a mathematician more.
Staples was charged with attempted burglary. The trial court found him guilty. Staples appealed.
