Legal experts are raising the prospect of the Federal Government's controversial community sports infrastructure grant program being unconstitutional.
The auditor-general was scathing in his critique of the $100 million program, find then sports minister Bridget McKenzie had ignored advice from Sport Australia in awarding grants to certain clubs.
The report also found a disproportionate number of grants were awarded to clubs in marginal Coalition seats.
Professor Anne Twomey from the University of Sydney says the constitution allows the Federal Government to pass laws on matters such as defence or trade, but not necessarily sport.
