Welcome to Kaumudy Global. These days we hear about many crimes that get charged under Protection of Children from Sexual Offences (POCSO) Act. Recently, the Delhi High Court made an interesting but significant observation about this. It pointed out that the intention of the POCSO Act is to protect children from sexual exploitation and that it was never meant to criminalise consensual romantic relationships between young adults.
Justice Jasmeet Singh made the observation in an order granting bail to an accused in a case registered under Sections 363/366/376 of IPC & Sections 6 and 17 of POCSO act.
"In my opinion the intention of POCSO Act was to protect children below the age of 18 years from sexual exploitation. It was never meant to criminalise consensual romantic relationships between young adults," Justice Jasmeet Singh mentioned while granting bail to the youth accused in POCSO and rape case.
