Earlier this year in Americans for Prosperity v. Bonta, the Supreme Court deemed as unconstitutional California’s law requiring nonprofits to disclose major donors. The Court decided that revealing donors to the state would intrude on civic groups’ right to assemble freely, but the decision also exposed just how under-defined this freedom is in constitutional law. How can a stronger legal framework for free assembly strengthen Americans’ ability to self-govern?
