Well, I'm Joseph Bovino, U.S. immigration and business attorney, and I’d like to help you understand 5 key parts of the new law.
Part 1: Employment Eligibilty and E-Verify
Okay, under the new law:
A. It is unlawful to knowingly employ, hire, recruit, or refer an "unauthorized alien" for employment in the state of Florida.
B. Employers must verify each new employee’s employment eligibility within 3 business days.
C. Private employers with 25 or more employees must use the federal E-Verify system for all new employees.
D. An unauthorized alien who knowingly uses a fake ID to obtain employment has committed a 3rd-degree felony.
However, please note:
An individual is not considered an unauthorized alien under this law if they have a work permit, even if they entered the U.S. illegally.
And individuals who are hired for casual labor to be performed within a private residence are not considered to be employees under this law. They’re independent contractors.
