Georgia independent blood testing is a way to protect your criminal record from a drunk driving conviction by having a doctor or hospital or private laboratory test your blood test results against the police test results.

Your request for an independent blood test after submitting to State's breath test (or even a blood test) must be "reasonably accommodated."

After you have submitted to an Intoxilyzer breath test or a blood test for the arresting officer, Georgia's implied consent law permits you to demand to be taken to a doctor or hospital of your choice for an independent blood test to be collected.

Because your blood will be sent off to a forensic testing laboratory for analysis, you can also ask to be taken to another breath test location for an independent breath test, in addition to the blood draw that case collected but for which no results were given. If the law enforcement officer fails to accommodate you, the state breath test or blood test taken by police can be excluded by the trial judge at a pretrial motion hearing, before the jury is ever bright in for voir dire questioning.
