Today in this video, I want to discuss with you DUI with Drugs. There's commonly DUI with Alcohol. Are you .08 or higher blood alcohol at the time of driving? Are you under the influence of alcohol at the time of driving? And then there's also a whole other charge of being under the influence of drugs. There's also a combination of drugs and alcohol. For purposes of this video though, I want to talk about DUI with Drugs.
Unlike alcohol, there's really not that hard and fast .08 or higher limit. So there are so many factors that need to go into it. The type of drug, the amount of drug that's in your system at the time of the test, the relation in time of when the test was taken verse when the drug was taken, verse when you were driving, and your tolerance to that drug may actually be something that can help you with your defense when charged with DUI with Drugs. DUI with Drugs also may help you with your Department of Motor Vehicles hearing because they don't have that hard and fast blood alcohol content, so the DMV may not be able to take action against your driving privileges only if you avoid a criminal court conviction. So you get through the DMV administrative process if you avoided DUI conviction in court your license may stay intact as well.
But what's essential about a DUI with Drugs are a couple of things, is you obviously do not want to give law enforcement more evidence than what they already have. Meaning, you know, a lot of times a DUI field sobriety test evaluations, the individual on the side of the road is being asked a lot of questions about when the first time they took the drugs, when the last time they took the drugs, how often they use the drugs; all those types of things. And you're under no obligation to answer those questions. So don't. Don't close a door to certain defenses, whether it's a DUI with Alcohol, a DUI with Drugs, or anything of the like.
And you also want to make sure that the law firm that you hire has real practical experience defending against DUIs throughout the jurisdiction of where your case would be.
