When you first learn how to cross-examine a witness, one of the first things they teach you is to never ever ask a witness a question to which you do not know the answer.
That's basic cross-examination 101.
Why then would an experienced medical malpractice attorney in New York during the a malpractice trial, while cross-examining a medical expert, make the dreaded mistake of asking the expert the dreaded "Why?" question?
I wish I knew the answer.
I saw him ask it.
The moment he asked the question, I knew he was finished.
I knew there would be no recovering from this question.
He asked the doctor whether he agreed with their main claim in the case.The opposing expert clearly stated he disagreed.
The next words out of the attorney's mouth shocked me.
The attorney then said "Tell us why, doctor"
This medical expert proceeded to tell the jury in exquisite detail exactly why the injured victim's claims were inaccurate. The doctor's answer lasted for minutes.
The doctor had taken total control of cross-examination.
That's something you learn as a newbie trial attorney to never ever do. You never give up the reins of cross-examination to a witness by asking an open-ended question or even a question to which you do not know the answer.
There is only one real exception to that rule.
That's where you simply don't care about the answer.
You don't care if the jury hears the answer or if anyone hears the answer. It's meaningless.
However, in this particular case it wasn't meaningless.
I can't imagine this attorney recovering from asking this one question.
