If the driver was not intoxicated on alcohol or drugs, and not driving recklessly, prosecutors will often charge 'misdemeanor vehicular manslaughter.' The penalty and punishment for this is up to one year of county jail. But if the person was driving under the influence, and/or if the driving was reckless, the crime will often be charged as a felony. As a felony, the sentencing for vehicular manslaughter is up to 10 years of state prison.
