How do you prove medical malpractice? In this video Sabrina Shaheen Cronin, the founder of the Cronin Law Firm discusses different types of malpractice and how you can prove your case.
What is Malpractice?
Malpractice is the failure of a professional to provide you with the services that meet or exceed the standard of care in his or her profession.
If you think a professional like a dentist or a doctor caused you some damages, you have 2 years to file a lawsuit for medical malpractice.
In general, you must find out what the standard of care is. You also need to know how that doctor committed malpractice. How did that standard of care get breached?
Sometimes, it is so costly to pursue a medical malpractice case, that even if malpractice occured the cost of litigation can outweigh the benefits.
If you're looking to file a medical or dental malpractice claim, get as many records as you can. It will save time, expense, and it will help the lawyer be able to know if you have a case or not. Keep a journal and take any pictures of your damage or injury.
It's important to feel comfortable with your lawyer. The litigation process is rarely easy, and a good attorney should guide you through the litigation process.
