What we need to talk about is what are your options, what to expect, and whether or not charges are going to actually get filed against you. That's the most difficult aspect about domestic violence? Because domestic violence is typically an accusation-type crime. It's somebody who you know. It's either your spouse or it's a girlfriend or boyfriend. Maybe it's a former significant other. It usually almost, 50% of the time is where someone has made an accusation, but the police weren't necessarily called on scene right away. There might not have been immediate physical injuries. There might not have been a trip to the hospital. But the scary thing about domestic violence is the fact that it can be either a felony or misdemeanor, depending on what you're accused of doing. So a lot of people ask, "What is my first step? What do I need to do, right now?"
Well, the first thing that you need to do is, you need to be quiet. And most importantly, is be quiet with the person who is accusing you, which is a very difficult thing because this person usually is a wife, or a girlfriend, boyfriend, somebody who you need to communicate with on a daily basis. You need to cease all communications regarding this accusation, immediately. Especially anything that could be written, like a text message, emails, social media posts. You need to cease all of that.
Second of all, you may be contacted by law enforcement. They might send a detective to follow up with you on this. You are not to be talking to anybody regarding this situation. They are not there to get your side of the story. They're not there to help you out. They are there to prosecute you. So, domestic violence can have serious life-changing consequences, even at only the misdemeanor level.
A lot of people lose their jobs over just a simple misdemeanor domestic violence conviction, loss of second amendment rights, 52 weeks minimum of classes that can be very burdensome on their work schedules. Their employers are not very accommodating with that. So it's very important with domestic violence that we get in front of this.
