So, Madison- Why Does the Difference Between a Mass Tort and Class Actions Matter?
The difference has a very big impact mostly when it comes to settlement. So, as we previously discussed, class action cases are treated as a unit. So, when a settlement or verdict is reached money is essentially divided up equally. There is no individual analysis of each case. However, each case is analyzed individually and the settlement is divided pro rata. Meaning people with grater injuries get a greater portion of the settlement versus peoples whose injuries aren’t necessarily as severe. It does take longer, but it usually yields more equitable results.
